OFFICIAL RULES

Contest Eligibility Requirements
MUST HAVE A LISTED BUSINESS ON DIASPORA CONNEX.

Participation constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules. “Entrant” includes anyone who enters as described below during the Contest Period. The Diasporaconnex Internet March 2015 Business Listing Contest (the “Contest”) begins at 12:00:01 a.m. Greenwich Mean Time (“GMT”) on March 1st, 2015 and ends as of 11:59 p.m. GMT on March 31, 2015 (the “Contest Period”). The Contest is sponsored by Diasporaconnex (“Sponsor”). Entries received after the Contest Period will not be counted toward this Contest.

Eligibility
– Any individual or Company with a registered business that is listed on diasporaconnex.com.
– Must be African owned or a business that promotes the growth of the African economy.

This Contest is a global contest. Only one entry shall be accepted per person. Employees, officers, directors, and agents of Sponsor, its parent company, subsidiaries, advertising, promotion, and fulfillment agencies, if any, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. All federal, state, and local laws and regulations apply.

How to Enter
Only one entry shall be accepted per person. Sponsor shall have the right to disqualify any entrant who attempts to submit multiple entries.
Any eligible person may enter by taking the following steps and meeting the following criteria during the Contest Period:
– Being or becoming a listed business on Diasporaconnex.com.
– Must be an African owned business or a business that promotes the growth of the African economy.

Mechanically reproduced entries will not be accepted. Sponsor is not responsible for late or misdirected sign ups. Entrants not complying with these requirements do not qualify.

Method of Winner Selection
Winners will be selected from all eligible entries received during the Contest Period by a panel of judges based on random selection. Judges will be looking for listed African owned businesses. There will be up to three (3) winners. The winners will be selected on or about April 3, 2015. All decisions are final and binding. Awarding of any prize is contingent upon verification that said registration was in compliance with these Official Rules. Verification of the validity of said registration shall be made in the sole and absolute discretion of Sponsor. Notices will be sent to Entrants electronically. Any Entrant without a valid email address on file with Sponsor will be disqualified.

Prizes
Each winner will receive an iPhone 6. One such prize will be awarded to each winner. No alternative prize, cash, or other substitution is permitted except by Sponsor in the event of prize unavailability. Prizes are non-transferable. All federal, state, and local taxes are the sole responsibility of each winner. Winners are advised to seek independent counsel regarding prize winnings. Based upon the criteria listed above, up to three (3) prizes will be awarded. The winners will be notified by email approximately one week after the selection.

Requirements of Winner
All potential winners are be required to sign and return releases of liability, declarations of eligibility, and where lawful, publicity consent agreements, as well as any tax information documents that may be required within thirty (30) days of acknowledged notification. If a selected potential winner cannot be contacted, is ineligible (under these rules or due to a failure to comply with any of the other applicable policies, licenses, rules, and terms of service), or fails to timely return the completed and executed releases/agreements as required, potential winner status may be forfeited and an alternate potential winner may, at Sponsor’s discretion, be selected.

Use of Winner’s Name and Likeness
By accepting and/or using the prize, the winner agrees to the use of his/her name, voice, and/or likeness for the purpose of advertising, trade or promotion without further compensation, unless prohibited by law. Winners’ names will be made available to the public.

General Terms and Conditions
Entrant agrees that under no circumstances, including, but not limited to, negligence, shall Sponsor, its parent, subsidiary, and affiliated companies, advertising, promotion, and fulfillment agencies, and legal advisors, and their respective officers, directors, employees, shareholders, agents, representatives, successors, and assigns (the “Released Parties”) be liable for any direct, indirect, incidental, special, or consequential damages arising from participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. Entrant waives any and all rights to bring any claim or action related to his/her participation in any forum beyond one (1) year after the first occurrence of the act, event, condition or omission upon which the claim or action is based. Each Entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final.

Sponsor reserves the right to disqualify any person or entry that Sponsor determines to be in violation of any term contained in these Official Rules. The Released Parties are not responsible for and shall not be liable for: (i) late, delayed, misdirected, incomplete, illegible, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor or any of the Released Parties that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result from participation in the Contest or arising from the entrant’s access to and use of the Internet site http://www.1and1.com (and all related websites of Sponsor), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Contest.

Sponsor reserves the right to cancel, suspend and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
